1. Agreement to these terms

These Terms and Conditions govern your use of the Only Local Marketing LLC website, ad builder, and shared direct-mail advertising services. By using the website, purchasing ad space, or submitting advertising content, you agree to these terms. If you are purchasing on behalf of a business or other organization, you represent that you have authority to bind that organization.

2. Our services

Only Local Marketing LLC offers shared postcard advertising in which multiple local businesses purchase individual advertising spaces on a printed mailer. Available markets, drop dates, mailing routes, household counts, ad dimensions, pricing, and space availability may vary by campaign and are shown on the website or during the purchase process.

3. Orders, pricing, and payment

The price displayed during checkout for the ad space and drop date you select controls your order. The website may advertise a standard price of $299 per ad, but campaign-specific pricing or promotions may apply. You authorize our third-party payment processor to charge the payment method you provide for the amount shown at checkout, plus any applicable taxes or fees disclosed before purchase.

4. Ad content and advertiser responsibilities

You are responsible for all text, logos, photographs, offers, coupon terms, business information, trademarks, and other materials you submit. You represent that you have the rights and permissions needed to use that content and that your ad complies with applicable laws, regulations, and industry rules.

Only Local Marketing LLC may reject, pause, or request changes to an ad that we reasonably believe is unlawful, misleading, infringing, deceptive, offensive, unsafe, technically unsuitable for printing, or inconsistent with the standards of the shared mailer. We may also require changes necessary to meet printing, postal, or production requirements.

5. Ad previews and production

The online preview is intended to help you review your ad before submission. You are responsible for checking spelling, prices, dates, coupon terms, contact information, and uploaded assets before final submission. Printed colors, cropping, sharpness, and other physical production characteristics may vary slightly from an on-screen preview.

6. Drop dates, mailing routes, and delivery

Available mailing routes are identified for each drop date during the purchase process. For campaigns in ZIP code 55311, each selected mailing route is scheduled to receive a maximum of one shared postcard per calendar month, so different drop dates within a month may be used to reach different homes.

Drop dates, household counts, and delivery timing are planned based on available postal and production information. Actual delivery may be affected by USPS operations, weather, printing or transportation issues, route changes, emergencies, or other circumstances outside our reasonable control. Unless specifically stated otherwise in writing, a drop date is a planned delivery date rather than a guaranteed delivery time to every household.

7. Cancellations and refunds

Any cancellation, credit, or refund terms shown during checkout or included in your order confirmation apply to that purchase. If no specific policy is shown, contact Only Local Marketing LLC promptly if you need to request a cancellation or refund review. Eligibility may depend on whether design, printing, mailing preparation, or other production work has already begun and on applicable law.

8. Third-party services

We may rely on third parties for payment processing, website hosting, printing, mailing preparation, postal delivery, and related services. Those third parties may have their own terms and privacy practices. Only Local Marketing LLC is not responsible for delays or failures caused solely by third-party systems or services outside our reasonable control.

9. Intellectual property

Only Local Marketing LLC retains all rights in its website, branding, templates, layouts, software, and original content. You retain ownership of content you submit. You grant Only Local Marketing LLC a nonexclusive license to use, reproduce, resize, crop, format, print, display, and distribute your submitted content as reasonably necessary to create, administer, promote, and deliver the advertising services you purchase.

10. No guarantee of advertising results

Advertising performance varies by business, offer, creative, timing, market conditions, and other factors. We do not guarantee any particular number of calls, leads, sales, redemptions, website visits, or other business results from an advertisement.

11. Disclaimer and limitation of liability

To the fullest extent permitted by law, the website and services are provided on an “as available” basis. Only Local Marketing LLC disclaims warranties not expressly stated in these terms. To the fullest extent permitted by law, Only Local Marketing LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, or lost business opportunities arising from the website or services. Our aggregate liability relating to a specific advertising order will not exceed the amount you paid to Only Local Marketing LLC for that order, except where applicable law does not permit such a limitation.

12. Indemnification

You agree to defend, indemnify, and hold Only Local Marketing LLC harmless from claims, losses, liabilities, and reasonable costs arising from advertising content you submit, your violation of these terms, your violation of applicable law, or your infringement of another party's rights.

13. Changes to these terms

We may update these terms from time to time. The effective date at the top of this page identifies the current version. Changes apply prospectively unless applicable law requires otherwise.

14. Governing law

These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws principles, except to the extent federal law or another applicable law controls.
